Yoga at the Park (YAP) Consumer Agreement

This Consumer Agreement ("Agreement") is a legally binding contract between you ("User") and [Your Company Name] ("YAP," "we," "us," or "our"), the owner and operator of the Yoga at the Park platform. By creating an account, participating in classes, or using any other services provided through the YAP platform, you agree to be bound by the terms and conditions of this Agreement.

YAP Services

YAP provides a platform that connects yoga instructors with individuals seeking to participate in outdoor yoga classes at public parks and beaches. Users may create and join classes, communicate with other users, and access other services and features through the YAP platform.

Eligibility

To use the YAP platform, you must be at least 18 years of age and capable of entering into legally binding contracts. By creating an account and using our services, you represent and warrant that you meet these eligibility requirements.

User Accounts and Responsibilities

To access and use the YAP platform, you must create an account by providing accurate and complete information about yourself. You are responsible for maintaining the confidentiality of your account information, including your username and password, and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. YAP will not be liable for any loss or damage resulting from your failure to safeguard your account information.

Conduct and Use of Services

As a User of the YAP platform, you agree to:

• Use the platform and services only for lawful purposes and in compliance with this Agreement, our Privacy Policy, and any other policies or guidelines we may provide.
• Provide accurate and up-to-date information about yourself and any classes you create or participate in.
• Not engage in any conduct that could harm or interfere with the YAP platform, other users, or the enjoyment of our services.
• Not use the YAP platform for any commercial purpose other than as expressly permitted by this Agreement or with our prior written consent.

Fees and Payment

Users may be required to pay fees for certain services provided through the YAP platform, such as class registration or premium features. All fees and charges are non-refundable, and you agree to pay them in accordance with our payment terms.

Cancellations and Refunds

Users may cancel their registration for a class in accordance with our cancellation policy, which we may update from time to time. Refunds or credits for cancelled classes will be provided at our sole discretion and in accordance with our refund policy.

Intellectual Property Rights

All content, features, and functionality available on or through the YAP platform, including but not limited to text, graphics, logos, images, and software, are the property of YAP or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, or otherwise use any content available on or through the YAP platform, except as expressly permitted by this Agreement or with our prior written consent.

Disclaimer of Warranties and Limitation of Liability

The YAP platform and services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or completely secure.

To the fullest extent permitted by law, YAP disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall YAP, its affiliates, officers, employees, agents, or licensors be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, loss of data, or other damages arising out of or in connection with your use of, or inability to use, the YAP platform and services, even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless YAP, its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the YAP platform and services, your violation of this Agreement, or your infringement of any intellectual property or other rights of any third party.

Termination

We may, in our sole discretion, terminate or suspend your access to the YAP platform and services at any time, with or without notice, for any reason, including but not limited to your breach of this Agreement. Upon termination, all provisions of this Agreement shall survive and continue in full force and effect, except for any provisions granting you access to or use of the YAP platform and services.

Changes to the Agreement

We may update this Agreement from time to time to reflect changes in our practices or applicable laws. We will notify you of any material changes by posting the updated Agreement on our platform and updating the effective date at the top of this page. Your continued use of the YAP platform and services following the posting of an updated Agreement constitutes your acceptance of those changes.

Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of New Mexico. Any disputes arising out of or relating to this Agreement or your use of the YAP platform and services shall be resolved by binding arbitration in the applicable jurisdiction, in accordance with the rules of the applicable arbitration organization.

Severability

If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable.

Entire Agreement

This Agreement, together with our Privacy Policy and any other policies or guidelines we may provide, constitutes the entire agreement between you and YAP regarding your use of the YAP platform and services and supersedes any prior agreements or understandings, whether written or oral, on the subject matter hereof.
